李桐豪指出，如果監督條例沒通過，服貿能否通過有法律上的疑問，去年立法院雖針對服貿決議要逐條審查，但「先監督（條例）、後服貿（協議）」只是口頭承諾，但是立院有屆期不連續原則，無法替第九屆立委做約束，因此有關服貿的遊戲規則還不知道。

對於兩岸服貿協議、貨貿協議後續處理，親民黨總統候選人宋楚瑜主張要尊重民意，先通過兩岸協議監督條例再談服貿貨貿。宋楚瑜財經幕僚李桐豪說，新政府上台後，服貿貨貿必然要修正，甚至可能重啟談判。

李桐豪表示，兩岸協議監督條例的前奏曲《條約締結法》已於7月通過，但由於國民黨和民進黨爭奪審查監督條例的主導權，因此延宕至今沒有通過，兩個政黨都應負起責任，未來新國會應該會比較快速處理該條例，但是當國民黨變成在野黨之後，新的執政者會如何看待現在行政院提出的版本，值得觀察。
